CITY OF GLENDALE
ORDINANCE NO. 04-2005
AN ORDINANCE PROVIDING FOR THE REQUIREMENT THAT PROPERTY OWNERS REPAIR DEFECTIVE SEWER SERVICE LATERALS; AND REPEALING ORDINANCE NO. 255.
The City Council of the City of Glendale finds as follows:
WHEREAS, the City of Glendale is in the process of constructing and improving the sewer system within and without the City of Glendale, Oregon, and
WHEREAS, DEQ has imposed a requirement on the City and its sewer customers that all sewer service laterals deemed by the city engineer to be deficient during said construction and improvements to the sewer system be repaired within a six month period after the date of notification to the responsible sewer customers, and
WHEREAS, City sewer mains have been smoked tested and subjected to a complete study to determine the points of infiltration and inflow of stormwater that need to be corrected,
NOW THEREFORE, The City of Glendale ordains as follows:
Section 1: No person shall cause or allow to be discharged, any stormwater, surface drainage, sub-surface drainage, groundwater, roof runoff, cooling water, or unpolluted water into the sewer system of the City of Glendale.
Section 2: All sewer customers are responsible to replace or repair the sewer service laterals on premises they own, occupy or control, from the residence(s) on such premises to the property line to prevent all such prohibited discharges.
Section 3: Failure to repair a sewer service lateral found to be in violation of this ordinance, following a six month period of notification, shall be deemed a public nuisance and may be abated as such under any and all applicable state or local provisions, and shall constitute a violation of applicable state and local regulations pertaining to the sewer system. Remedies for such violations as provided under any other applicable sewer regulations may be pursued against any and all persons responsible. Such violations and nuisances may be abated and prosecuted as set forth in any other applicable City ordinances.
Section 4: Ordinance No. 255 is repealed.
Section 5: Emergency Clause: the City Council deeming the prompt passage of this ordinance necessary to the public health, safety and welfare of the citizens of the City of Glendale, Oregon, hereby declares an emergency and this ordinance shall be in full force and effect upon its passage by the City Council and approval by the Mayor.
