ORDINANCE 02-2006
AN ORDINANCE REPEALING ORDINANCE 330 AND PROHIBITING MINORS FROM BEING IN PUBLIC PLACES DURING CERTAIN HOURS AND PROVIDING A PENALTY
THE CITY OF GLENDALE ORDAINS AS FOLLOWS:
Section 1. Curfew Imposed. No minor under 18 years of age shall be on a street, highway, park, alley or other public place between the hours specified in Section 2 unless:
1.The minor is accompanied by a parent, guardian or other person 21 years of age or over and authorized by the parent or by law to have custody of the minor;
2.The minor is engaged in a lawful pursuit or activity which requires the minor�s presence upon the street, highway, park, alley or other public place; or
3.The minor is emancipated under ORS 109.550 to 109.565.
Section 2. Curfew Hours. For the purpose of this ordinance, the applicable hours of curfew are:
1.Daily between 12:00 midnight and 5:30 AM of the following morning.
Section 3. Parental Responsibility. No parent, guardian or other person having legal custody of a minor under the age of 18 years shall permit the minor to be in violation of this ordinance.
Section 4. Action Taken in the Event of Violation. Any police officer having reasonable grounds to believe a minor has violated this ordinance may take said minor into temporary custody as provided by ORS 419C.080, 419C.085 and 419C.088 and said minor may be subjected to further proceedings.
Section 5. Refusal of Parent or Guardian to Take Custody. No parent, guardian or other person having legal custody of a minor taken into police custody as provided in Section 4 shall refuse to come immediately and take custody of the minor upon being notified to do so by the police.
Section 6. Penalty. Violation of a provision of this ordinance is punishable by a fine not be exceed $100 for the first offense.
Section 7. Repeal. Ordinance #330, enacted on May 26th, 1998 is hereby repealed.
Section 8. Emergency. As the City Council deems the prompt passage of this Ordinance necessary to the public health, safety and welfare of the citizens of the City of Glendale, Oregon, an emergency is hereby declared to exist and this Ordinance shall become effective immediately upon its passage by the Council.
